In the state of West Virginia, it is illegal to drive a vehicle with a blood alcohol level, or BAC, of .08 or higher. The BAC limit for commercial drivers is .04 and .02 for any driver under the age of 21. This law also prohibits the use of narcotics, inhalants, and other intoxicants that alter the mind. Penalties for drunk driving include:
FIRST CONVICTION: 24 hours to six months of jail time, a fine of $100 to $500, driver’s license suspension for six months, and the completion of a safety and treatment program before your license is reinstated.
SECOND CONVICTION: Six to 12 months in jail, a fine of $1,000 to $3,000, driver’s license suspension for one to ten years, mandatory interlock system, and the completion of a safety and treatment program before your license is reinstated.
THIRD CONVICTION: One to three years in jail, a fine of $3,000 to $5,000, either a lifetime revocation of your driver’s license or a one-year suspension followed by an interlock device system and the completion of a safety and treatment program.
PLEA BARGAIN: The DUI charge is reduced to a reckless driving conviction involving alcohol (also known as “wet reckless”), although there is no statute in West Virginia so it is up to your attorney and the court to accept.
