West Virginia Divorce Requirements

In order to file for a divorce in West Virginia, at least one of the spouses must be a legal resident of the state for one year or more before the divorce is filed. The court has the right to grant a divorce for any grounds set in place by the state, which includes:

Irreconcilable Differences
Adultery
Felony Conviction
Habitual Drunkenness or Alcoholism
Willful Abandonment For At Least Six Months

Permanently Incurable Insanity
Abuse or Neglect of a Child in the Immediate Family
Cruel or Inhumane Treatment of either party against the other
Habitual Use of Drugs or Addiction
Voluntary Separation without Cohabitation or interruption for at least one year

There are, however, some stipulations to these grounds that are best left to be discussed with your lawyer. For instance, if adultery took place more than three years before a divorce has been filed, a court may not grant it.
